E-bike hire terms and conditions

I acknowledge that the use of e-bikes can be dangerous and acknowledge the risks involved in the use of them and I fully indemnify EMTB Adventures Valencia against claims of injury to myself or any third party unless it can be proven EMTB Adventures Valencia did not fulfil reasonable maintenance procedures for the equipment being used.

I understand that by making a booking I am expressly agreeing to the terms and conditions of the hire in entirety. I understand that full payment is required at the time of booking and the payment will not be refunded if I cancel the booking fewer than 48 hours before my collection time/date.

I understand that I should wear sensible shoes (flipflops are not advisable) and clothing.

I confirm that I am a competent cyclist, and the e-bike will not be ridden by any other persons.

I agree to follow all laws pertaining to the e-bikes, including all national and local laws and the rules and regulations pertaining to bicycles in the country in which I am riding. Furthermore, I certify that I am familiar with the laws, rules, and regulations pertaining to the use of the e-bikes before riding.

I confirm that I will not ride illegally such as cycling under the influence of drink or drugs etc. EMTB Adventures Valencia reserves the right to cancel the booking without refund of any person suspected to be under the influence of drink or drugs.

I recognise I will be riding an e-bike which I may not be familiar with and I will therefore exercise care and attention in the use and operation of the e-bikes and that I will not undertake any manoeuvre that is beyond level of skill or ability or is unsuitable for the e-bikes capability.

I confirm that I:

1. understand the UK Highway Code

2. understand that we should keep to the left on unmarked roads and confirm that I will respect other road users and pedestrians and take special care around horses, and country roads

3. will under no circumstances use the e-bikes on public pavements or footpaths

4. can use gears and brakes correctly

5. do not have any pre-existing medical condition that would preclude the use of the e-bikes or affect my safety on the e-bike

6. am good health and that my eyesight is of the required standard for driving on public roads and I am not suffering from any medical condition which could adversely affect my safety on the e-bike.

I understand that I inform you at the time of collection if am not happy with any of my rented equipment and that if I encounter a problem whilst riding I will call you from a mobile phone to report the fault.

I confirm that I or at least one person in my group can fix a puncture or fit a tube and that I will not receive a refund in the event that I or any member of our group sustains a puncture.

I accept that in the event I or any member of our group is unable to use the e-bike during the hire period due to mechanical failure, a refund will only be issued on the bike affected and only if EMTB Adventures Valencia are unable to resolve the issue forthwith.

I understand that I must return the e-bike back at the specified time and that late returns could affect other bookings. I agree that I may be charged additional fees so that EMTB Adventures Valencia can use these monies to refund the affected customers.

I understand that I am responsible for my hired equipment and that I will be responsible for the payment for any damage to (including third party), or loss of, any equipment.

I agree to transport the bike safely in a suitable vehicle and if using a bicycle carrier/rack on my vehicle, I will check the weight restrictions are within it’s limits. I understand that EMTB Adventures Valencia reserves the right to stop me transporting the bike if they deem the means unsuitable

I understand that I should not attempt to make any alterations to the bike as to do so may be considered damage and incur a charge to correct.

I confirm the e-bike must be locked through the frame when not in use. I understand that in the event the e-bike is stolen, I will be liable for a charge of up to £4,000. I understand that EMTB Adventures Valencia recommend the e-bike should not be left unattended in public places even when locked, due to the high risk of theft.

I understand that EMTB Adventures Valencia only accept payment by credit / debit card. In the event of loss or damage, the card may be used for payment for any damage or loss of equipment (this cost will be discussed before payment is taken).

I understand that official proof of Identification (passport or driving licence) must be left before the e-bike can be taken. Identification is also taken (and locked away safely) as security until the bikes are safely returned.

I understand the risks of riding an e-bike, accept full responsibility for my own safety and understand that Botley MTB cannot be held liable for any injuries sustained to myself or any other persons in my group. I will wear a helmet at all times whilst riding.

The Terms and Conditions are covered by English Law. In the event that any of the conditions listed above are unenforceable then the remainder shall remain in full force and effect.
